14th Amendment of the US Constitution
Some have argued that the President could unilaterally raise the debt limit. I believe the Constitution places that power on Congress and, therefore, if Congress fails to exercise this power and raise the debt limit, it will put itself outside the Constitution
It is clear that Section 4 of the Amendment considers unconstitutional that the US Government could default (Section 4) but also says: “Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article”
Raising the debt limit is a subject of the Constitution. Therefore, it is an issue on itself, not tied to other issues such as taxes or expenditures. The fact that raising the debt limit has been tied to those issues is therefore unconstitutional and failing to act on this issue is also an unconstitutional act on Congress
Should the Government take Congress to court for the violation of the Constitution or should it take to court those that are voting against raising the debt limit?
Wolf, I have a great opinion about you and your integrity. However, I am disappointed about the coverage of the debt limit issue. You and other CNN reporters do provide opinions (not just providing the news) and have (with few exemptions) been tryng to be in the middle. The American people thru your own polls have provided opinions about who is responsible and who is not. Who is more responsible and who is telling the thuth. I believe if you give opinions you have the obligation to discern these issues and not telling that both sides are the same
